Cookies, as described by the reference legislation, are small text strings that the sites visited by the user send to his/her terminal (usually to the browser), where they are stored and then transmitted to the same sites the next time the same user visits. a. Technical cookies

Technical cookies are those used for the sole purpose of "carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the user to provide such a service" (see Art. 122, paragraph 1 of the Code). They are not used for any further purposes and are normally installed directly by the website owner or operator. They can be divided into navigation or session cookies, which ensure normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); analytics cookies, which are assimilated to technical cookies where they are used directly by the website operator to collect information, in aggregate form, on the number of users and on how they visit the website itself; functionality cookies, which allow the user to navigate according to a series of selected criteria (e.g. language, products selected for purchase) in order to improve the service rendered to the same. Profiling cookies are aimed at creating profiles of the user and are used to send advertising messages in line with the preferences expressed by the user while surfing the web. Because of the particular invasiveness that such devices can have in the private sphere of users, European and Italian legislation provides that the user must be adequately informed about their use and thus express his valid consent. They are referred to in Art. 122 of the Code where it provides that 'the storage of information in the terminal equipment of a contractor or user or access to information already stored is permitted only on condition that the contractor or user has expressed consent after having been informed in the simplified manner set out in Article 13(3)' (Art. 122(1) of the Code).
